2026 What happened to me today!

Good grief, it's quick too! I was just looking and yesterday I changed a thread title from Winter Wonderlands, to The Beauty of Winter Wonderlands (again for uniqueness sake). And Google has already indexed it! :shock:

Jan. 2nd -My mom died, she was 83. :cry:
Jan. 18 -My wifes dad (my father in law) died, he was 70. :cry:
Jan. 18 - Engine went out on my mini van driving my daughter home from hospital. Only 110k miles on the thing. :sick:

Hope it gets better....

I have spent most of today drafting a claim of copyright infringement (nothing to do with photography) under the terms of the Digital Millennium Copyright Act on something I uploaded to the net under a Creative Commons Licence. I'm left doubting that it was worth the hassle. Now to wait and see how it goes, but next time I think I'll just withdraw the work in question (along with the considerable amount of other stuff I've uploaded under similar terms). I have better things to do.
 
I thought about that once, I posted a photo from a Cowboy Shooting match on the SASS facebook page, three months later it was published in the SASS Chronicle magazine with no credits. Maybe once a photo is posted on someone's facebook page it becomes their property, I don't know.

I very much doubt that. I only have a slim understanding of UK copyright law and even less about US copyright law, but I think it's a pretty universal concept that copyright automatically lies with the creator unless they specifically waive their right to it, or licence use to someone else. Facebook has terms and conditions relating to all sorts of things including photos, but, unless I am mistaken, is to protect themselves; it doesn't make you photos public domain.

But didn't you publish them under a CC license?

I turned all my images to CC BY-NC-ND and they are being used here and there but all have given me credit. The coolest one was an image of mine in the Ukrainian Pravda, on the lifestyle pages. I had a pic of a kissing couple where the woman clearly was the one in charge and they used it with an article on how women take initiative these days.

Yes, but that doesn't negate my copyright. My copyright still exists and I permit use within the terms of the CC licence, which, like yours, is CC BY-NC-ND. This basically means that I'm happy for people to use my creation, so long as they don't use it commerically, or use it to create further versions. In the case I wrote about above, I was complaining about an unauthorised derivative version. I have just learnt that my complaint has been upheld and the offending creation removed from the web. At least my afternoon wasn't wasted. :)

In your case, I would have thought that Pravda were using your image for commercial purposes (generating sales) and should have sought your permission. Probably a minefield though.

That's a clear violation of that CC license. I think when somebody does that they expect people to not complain thinking it will be too much of a bother. Good for you for taking them on!

It was indeed a violation, the more so because at that time the image was fully copyrighted, so although they did credit me they had no right to use that image without my consent. Although I'm not sure you can really say they used it commercially. Yes, it was in a newspaper but on the lifestyle pages as an illustration of what was said in the article. However, I did look into it, but the Pravda in Ukraine? How do you do that? Had it been used in the US or the UK or a country in the EU I would've taken action, but it really was too much of a bother to pursue this so I just shrugged it off.

Yeah, policing the whole world is an impossibility. Even the tangerine cry-baby can't do it (though he seems to think he can).

That Song Thrush is nice and seems to be within the CC terms..

I played Chickenfoot (a domino game) today with the ladies at the Senior Citizens Center. I actually won a game. First time in forever that I actually won.
